In addition to employment contracts, clawback provisions are also used in other circumstances. The Medicaid Recovery Program (essentially a clawback provision) allows Medicaid to recover the money paid for health care from a deceased Medicaid beneficiary. Elizabeth Davis, RN says the period during which an agreement will be reached will depend on what might be in contemplation and, in general, the respective negotiating positions of the parties. Rules covering 10 or 15 years from the date of entry are common, but up to 20 years are not scandalous. Clawback agreements are often used in a rural setting, when land is sold for use and is therefore priced – but it is reasonable to consider that land use may change in the future. The classic example is an additional garden lot that has the potential to become a plot of land for a new home. The Dodd-Frank Act of 2010 requires the SEC to require U.S. limited companies to include in their compensation contracts a clawback provision that results from an accounting liability (regardless of fault (the clawback provisions under the Sarbanes-Oxley Act apply only to intentional fraud). As of mid-2015, this part of the Dodd-Frank Act had not yet been implemented.  With regard to the second area in which problems arise, an obligation to pay for overruns is a positive obligation and, therefore, an alliance of the purchaser cannot work with the Land. The authors of the rehab have sometimes attempted to circumvent this problem by building a restrictive contract preventing the construction developer from starting construction of the houses, unless they have paid the amount indicated to the owner. This is a clumsy and unsatisfactory approach, as it is obviously not possible to protect the customer`s position, as happened in Akasuc Enterprise Ltd against Shirreff  EWHC 1275 (Ch).
For many buyers, a relapse is something, which is not maintained and can therefore influence market value, while others who wish to buy farmland are not discouraged by the recovery, simply because they do not intend to develop the country and/or if the country develops later, this is considered a bonus and the new landowner may be content to share the “wind blow” payment with the original seller who sold the land to a value. Clawbacks differ from other refunds or refunds because they often come with a penalty. In other words, a worker must pay additional funds to the employer if the recidivism takes effect.
